Text Messaging Agreement and Consent

By responding to a text message, the individual(s) referring or responding to the SMS texting program (“Program”) sent by or on the behalf of Allen College, Trinity College of Nursing and Health Sciences, and St. Luke’s College (collectively “UPH Colleges”) agrees to all terms and conditions in this Agreement and are opting into receiving text messages. This Agreement is formed between you and the UPH Colleges.

You are consenting to UPH Colleges sending text messages to your cellular phone or other wireless devices for the purposes of your education and related activities including without limitation information about campus events, application statuses, admissions communication, and faculty-to-student communications. Message frequency will vary.

The UPH Colleges do not charge for this Program; however, message and data rates may apply from your mobile carrier. You are responsible for any carrier fees such as data plan charges, text messaging charges, out-of-area roaming, tolls, and other charges.

To opt-out, reply “Stop” to the text message you received to stop receiving text messages from the Program. By enrolling in the Program, you agree that, in the event of a request to unsubscribe, you will receive a single concluding message from the Program confirming the stopping of text messages.

Text messages may not be delivered for a number of reasons including if the mobile phone is not in range of a transmission site, or if sufficient network capacity is not available at a particular time. Even within a coverage area, factors beyond UPH Colleges’ control may interfere with message delivery, including the customer’s equipment, terrain, and proximity to buildings, foliage, and weather. No guarantee is made that alerts or messages will be delivered, and neither UPH Colleges nor the carriers will be liable for delayed or undelivered messages.

The UPH Colleges may use an automatic dialing system to deliver text messages to you. The Federal Communications Commission generally defines an “automatic telephone dialing system” or autodialer as equipment that has the capacity to store or produce telephone numbers to be called and to call such numbers. By your agreeing to the Program, you give your consent to the UPH Colleges to use an automatic dialing system to deliver text messages to the telephone or cell phone number to which you have directed the UPH Colleges to auto transmit text messages.

The UPH Colleges reserve the right to modify these Terms and Conditions at any time. Your continued use of the Program constitutes your acceptance of the new terms.
